GENERAL:
2. The decision of ESPN & KLM shall be final in all matters relating to this promotion and no correspondences will be entertained. ESPN & KLM reserve the rights to change these terms and conditions without prior notice. A participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same on the micro-site of either ESPN or KLM and shall be deemed to have accepted such amendments or interpretations by virtue of his/her continued participation in the promotion. Should a participant not wish to continue to participate in the promotion pursuant to the prevailing terms and conditions as amended or interpreted, he/she may terminate participation in the promotion upon written notice to ESPN.
3. This Contest cannot be clubbed with any other offer or Contest.
CONTEST DETAILS:
4. The Contest is valid from October 6 to November 9, 2008 [hereinafter referred to as “The Contest Period”] in cities and towns across the country.
5. This contest is based on lucky draw. Participants would have to download the espnstar.com Desktop Cricket widget, after filling up the form on the website, by giving their Name, Email ID, Contact no. etc. Every week 10 Lucky winners will be selected on a random basis & 1 Grand Prize winner will be selected at the end of the Contest period. The prizes are mentioned in point no. 9 written below.
6. ESPN & KLM may require winner(s) to provide proof of identity, age and residency. Identification considered suitable for verification is at the discretion of ESPN & KLM.
QUALIFYING ENTRIES:
7. The Contest is open to all residents of India only above the age of 18 years except directors and employees and affiliate/associate/subsidiary Companies of ESPN, KLM and their family members and relatives.
8. ESPN or KLM may, in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
PRIZES:
9. Winners will be selected on a random basis & will win:
- 10 Lucky winners every week will win an ESPN STAR Sports T-shirt each.
- 1 Grand Prize winner will win 1 return ticket to Amsterdam; ex-India only on KLM operated flights.
10. Prizes are non-transferable and non–substitutable with cash or kind and subject to Tax Deduction at Source, wherever applicable. The winner must claim his/ her prize by Dec 31, 2008. In case the prize is unclaimed by the winner within the stipulated period, the winner automatically surrenders his/ her right to the prize and shall not have any claim, thereafter and in such an event, ESPN or KLM reserves its right to transfer the prize to the next winner chosen in the same draw. Prizes will be dispatched by ESPN after the contest ends to the address provided by the winner (winners will be contacted on their email IDs or mobile numbers as filled by them in the online form).
11. If a winning entry or the winner is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined. ESPN’s and KLM’s decision is final and no correspondence will be entered into.
12. ESPN & KLM may at anytime, at its discretion, change the prizes mentioned above without prior notice. The prizes are given subject to applicable taxes and any tax or levy shall be solely to the account of the winner. ESPN & KLM accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
LIABILITIES:
13. Neither ESPN nor KLM accept any responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. ESPN & KLM have no control over communications networks or lines and none of them accepts any responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. ESPN & KLM are not liable for any consequences of user error including (without limitation) costs incurred.
14. ESPN and/or KLM, reserve the right to, terminate, modify or extend this the Contest, at any time at their absolute discretion, without assigning any reason. Decision of ESPN & KLM will be final and binding regarding this contest and prizes.
15. All disputes are subject to the exclusive jurisdiction of the courts or forums in New Delhi.
16. Each of ESPN, KLM or any of its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Without limiting the previous paragraph, ESPN and KLM and its associated agencies and companies will not be liable for any damage in transit to prizes.
17. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of ESPN or KLM which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, ESPN or KLM may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries.
18. ESPN or KLM shall not be liable for any delay in performing, or for failing to perform, any or all of its obligations resulting from any cause beyond its reasonable control in the nature of fire, explosions, natural calamities, State Emergency, riots, etc.
OBLIGATIONS:
19. The winners must, at the request of ESPN and KLM, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to ESPN and KLM using their name and image in promotional material.
20. Unless otherwise indicated ESPN and KLM shall deem the information voluntarily supplied during the course of the Contest and /or personal information provided by the winners as non-confidential, which hereby discharges all obligations of confidentiality. ESPN and/KLM shall be free to send promotional messages to all the participants on their Email IDs and/ Mobile numbers filled in the online form. ESPN and KLM shall be free to reproduce, use, disclose and distribute the information to third parties without limitation.
21. Filling up the online form constitutes acceptance to the Terms and Conditions of the Contest. All promotional materials, including details on how to enter and claim prizes are part of these Terms and Conditions of Entry.
22. These terms and conditions are governed in accordance with the laws of India. Any dispute shall be subject to the jurisdiction of courts in Delhi, alone.
